The following terms and conditions as well as all the other relative rules adopted by Farnese Gioielli S.r.l. and made available as indicated (collectively, “Conditions of sale“) will apply to all sales of Farnese products that you (the “Customer” or “you“) can order on the website (www.farnesegioielli.com) (the “Website“) of Farnese Gioielli Srl whose office is located in Piazza di Spagna 72 / A, Rome, Italy (“Farnese Gioielli” namely indicated in this document with Farnese, “we“, or “our“) (the “Customer Contact Center”).
These Conditions of Sale only apply to purchases made by the Customer Contact Center or from the Website. Farnese may change the Conditions of Sale from time to time, in its sole discretion.
2. WHO CAN PURCHASE
Only those who (a) have reached the age of majority (eighteen years in most countries), (b) have the legal capacity to enter into contracts can order from the Website (for further details, please consult the payment and shipping sections below). If you are underage or unable to stipulate a contract as required by law, you must be a parent or a legal guardian to enter into an order in your name and then accept these Conditions of Sale. Farnese reserves the right to modify the range of items proposed on the website and may limit, from time to time, the quantity of Farnese products that the Customer can order for each purchase session. The pages related to the product on the website provide all the information relating to the products currently on sale, Please remind that: only the creations that have the “Add to cart” button are available for sale through the website. 4. ACCOUNT REGISTRATION: PERSONAL INFORMATION
To make an order from the website, the customer must register and create an internet account, except for the case where you select “Guest Checkout” on our website. 6. PRICES, TAXES, SHIPPING COSTS
All prices shown on the product pages of the website are inclusive of VAT and shipping costs. The currency used will be updated based on the shipping destination after receiving the delivery address.
Farnese reserves the right to modify prices and delivery costs on its Platforms at any time and without notice. The price of a product and the delivery costs specified on the website, as indicated by Farnese when confirming the order, will be honored by Farnese. Any description or information regarding the weight of the precious materials and the number of stones and carats is given as a guide and may slightly vary.
Please note that changes to the applicable law between the order date and the date on which the user receives an order confirmation may change the tax associated with the purchase. If the resulting change is an increase in the sales tax charged to you, we will contact you and ask you to reconfirm the purchase.
We can offer a VAT refund mechanism for products delivered in some countries of the European Union, USA and Canada not beyond the thirty (30) days from their export outside the European Union. This mechanism will not be available for the customers in the European Economic Area
7. CUSTOMER’S CONFIRMATION AND CHECK
The Customer is required to carefully check each purchase details before proceeding with the order on the website.

Under this contract, the services of payment procedures for goods and / or products purchased on this Website by credit or debit card are provided by GEST PAY depending on the type of payment method used for the purchase of the goods and / or services.

11. BOX AND PACKAGING
The products will be delivered in their cylindrical packs and in turn will be placed in a packaging box wrapped in bubble-wrap material. Within the same box it will also be placed the leaflet of the Share Your Smile Collection line.
If the customer or the recipient of the gift decides to return the product, they can do so as long as the product is returned in its original packaging.
12. SHIPPING POLICY
We only accept orders having as delivery addresses one of the following countries located in Europe: United Kingdom, France, Belgium, Netherlands, Luxembourg, Ireland, Spain, Portugal, Italy, Germany, Austria, Denmark, Sweden, Finland, Czech Republic, Bulgaria , Greece, Poland, Hungary, Malta, Lithuania, Slovakia, Romania, Croatia, USA and Canada. Estimated delivery time will be indicated on the website before ordering and it will be summarized in the order receipt. For further information, please consult the website or contact Customer Service.
When estimating the delivery time of the package, it will be evaluated the time necessary for credit approval, for the verification of the address and for the processing of the order. When the order is finalized and ready for shipment, Farnese will send the order confirmation by email.
We will do our best to ensure delivery by courier within the expected delivery time, from the date of our order confirmation.
Each delivery package will contain, in addition to your purchased Farnese product: (i) all relative accessories, if any, (ii) a thank-you note, if any; (iii) the leaflet of the Share Your Smile Collection line; (iv) a paper ticket with your message if any; (v) the package without price.
Farnese insurance covers the purchase for the transport time and up to delivery to the customer. An adult’s signature is required to confirm the delivery of each Farnese product. From that moment on, the responsibility of the product passes to the Customer.
When ordering on the website, as a customer, you will have the option to choose to receive an invoice to your billing address. It is possible to request an invoice at any time by contacting the Customer Service (telephone number indicated on the website) providing a correct identification. Farnese will not send the invoice and payment details to the shipping address if different from the billing address.
14. RIGHT OF WITHDRAWAL
If the Customer is resident within the European Union, he/she has the right to delete the contract within 14 days without having to justify it. This period will expire within the fourteen (14) days following the day on which the Customer, or another person on behalf of the Customer, takes possession of the product.
To exercise this right of cancellation, you can contact the Customer Service (telephone number and e-mail address indicated on our website) to obtain a Return Number (RN), which we will confirm in writing. If the Customer withdraws from the contract, the payments already made will be reimbursed, including the delivery costs, with the exception of additional costs, relating to the shipment made by the customer to the Farnese office for the return of the goods that must in any case take place within 14 days from the date in which we will be aware of your decision to withdraw from the contract.
We will reimburse using the same means of payment used by the Customer for the initial transaction; in any case, there are no fees for this reimbursement. Farnese may suspend the refund until it has received the returned products or until the Customer has documented the return of the products. The Customer will return the products or send them to us promptly and in any case within 14 days from the date on which you communicate the decision to withdraw from the contract. This deadline will be deemed respected if you return the products before the expiry date of 14 days. Farnese will not support the cost of the returning products.
The Customer will be responsible for any decrease in the value of the product if the deterioration is caused by a use that goes beyond the ordinary quality inspection and functional tests carried out on the product. “Quality inspection and functional testing” should be understood as a verification of the product usually made in a retail store. As a result, if the product is damaged, Farnese will deduct the cost of the repair or replacement from the granted reimbursement.
15. RETURN PROCEDURE
15.1. Return procedure
The products purchased on the website can be sent to the following address: Farnese Gioielli S.r.l. Piazza di Spagna 72 A 00187 Rome. Products that have not been purchased on the website CANNOT be returned to Farnese e-commerce.
To facilitate the return procedure, please follow the instructions below:
1) contact the Customer Service (telephone number and email address indicated on our website) to inform us of the withdrawal decision and to request a Return Number (RN) (at the communication cost we will not apply any surcharge).
For all the products, as follow
IN CASE OF DELIVERY WITH A COURIER CHOSEN BY THE CUSTOMER
i) Contact Farnese Customer Service to communicate your intention to withdraw and request the return number (RN) that need to be attached to the return form.
ii) Contact the customer contact center of the chosen courier to organize the pick-up.
iii) Enter the return number (RN) on the return form received by email from your courier and sign it.
iv) Include the completed return form with the product, its accessories if any, the Product leaflet and all other documents if any, in the original box and in the delivery package,
v) Seal the delivery packaging and secure the prepaid delivery label on it,
vi) Deliver the package to your courier for shipping.
IN CASE OF DELIVERY WITH A FARNESE COURIER PARTNER
i) Contact Farnese Customer Service to communicate your intention to withdraw and request the return number (RN) that need to be attached to the return form.
i) The Customer Contact Center will complete the on-line TNT return form on your behalf and it will promptly send the completed return form to your email address.
iii) You will need to print out the return form, sign it and deliver it to TNT upon collection. If you do not have a printer, the TNT hub will give you the printed form at the time of collection.
iv) Insert the completed TNT return form with the product, its accessories if any, the Product leaflet and all other documents, if any, in the original box and in the delivery packaging.
v) TNT will pick up the package and send it to our warehouse.
The Customer, or the Recipient of the gift, depending on the case, must keep a proof of the returned product’ shipment, and Farnese does not accept any responsibility in case of absence of such proof. Only the goods received from the Farnese e-shop can be reimbursed or changed with another product, depending on the case.
After receiving a returned product, Farnese will verify that the product complies with the Conditions of Sale.
15.2. Conditions for returning a product
In addition, you need to return the original Farnese box and delivery packaging, with the product, its accessories if any, the product leaflet and all other documents if any, in the original box and in the delivery package with all the protection materials in order and the labels and stickers fixed on the outer packaging. Otherwise, Farnese has the right to withhold the corresponding value from the reimbursement granted to the Customer, or to refuse the return and to return the product to the Recipient of the gift.
All the returned products will be subjected to Farnese’ strict Quality Control (QC) to ensure that the returned products comply with the above requirements.
If the returned product meets the Quality Control (QC), Farnese will proceed with the reimbursement or with the product change, as appropriate.
15.3. Product change of customers and gifts recipients
Customers and gifts recipients can contact Farnese Customer Service to change a product purchased on the website with another Farnese product if the product to be changed meets the Conditions of sale.
If a product is returned from a customer or gift recipient in order to change it with another product on the Farnese e-shop, only the customer will be entitled to receive a refund of the price difference, if the product to be changed is more expensive than the desired Farnese product. If the returned product is cheaper than the desired product, the customer or gift recipient, depending on the case, will have to pay the price difference.
In both cases, Farnese will send an email to the Customer which specifies the value of the returned product, the price of the item with which the original product has been changed and the difference that the Customer must pay or the amount that the Customer has the right to receive. All shipping costs will be covered by the customer.
16. MANUFACTURER’S WARRANTY
Farnese takes extreme care to ensure that each product strictly respects the company’s quality criteria and that it has passed all the tests, both in a functional and aesthetic sense.
The chosen products are lifetime covered by Farnese Gioielli’s International Guarantee that expect to replace their silver jewel (therefore not the SMILE in leather) if they are worn out by time, at the nearest retailer. This operation must be communicated in advance to the Farnese Customer Service which will coordinate all the phases of the change management.
17. LEGAL WARRANTY
The consumer holds legal rights according to the national legislation in force that regulates the sale of consumer goods; these legal rights are not affected by these Condition of Sale.

19. PRICES ACCURACY AND PRODUCTS DESCRIPTION
Farnese pays the utmost attention to ensure that the information published on the website is accurate, in advertising or in the catalog. However, Farnese does not provide any guarantee, either expressed or implied, on the accuracy, reliability and completeness of this information. Farnese does not confirm the price of a Farnese product until the confirmation of the order has been issued by Farnese, which confirms the existence of a binding sales contract. If the actual price of a Farnese product is higher than the price indicated on our website, Farnese must contact the customer for instructions before sending the order, or, if Farnese cannot obtain these instructions, It can reject the order and notify this rejection to the customer.

Farnese or the customer will firstly devote all the necessary efforts for a period of thirty (30) days to solve in a friendly manner any dispute or disagreement that may arise on the product, on the Conditions of Sale for any violation of the latter.
